(a)
The previous orders restricting the approval of appointments such as executing bond as per GO(P) No.10/10/Gl.Edn dated 12.10.2010, deployment of protected teachers in newly opened school, uneconomic school etc were not repealed in the present Government Order. The implication of the above Government Order before and after the issuance of Government Order requires clarification.

               Consequent on the issuance of the GO(P) No.199/11/G.Edn. dated 1/10/11 the orders such as GO(P) No.178/2002/G.Edn. dated 28/6/02, GO(P) No.46/06/G.Edn. dated 1/2/06, GO(MS) No.259/06/G.Edn. dated 12/10/06, GO(P) No.10/10/G.Edn. dated 12/1/10 etc. have relevance only up to 1/10/11.

               However, GO(P) No.199/2011/G.Edn. specifically addresses the case of all appointments entangled with the issues covered in the various executive orders referred in your letter. It is clarified that in all such cases appointment approval can be given with effect from 1/6/2011 and prior service before the current academic year will be reckoned in line with the proposed amendment to KER. In other words in all such cases appointment approval can be given in two stages. in the first stage, if the teacher in included in Appendix-I, they may be given approval with effect from 01/06/2011. Approval for the prior period may be given on a case to case basis in the 2nd stage after the KER amendment comes into effect.

(b)
In the case of promotes (43 claimants) who were appointed in the additional vacancies from 2006-07 onwards whether they are to be paid salary of the promoted post from 01.06.2011 or from the date of promotion. Substitutes appointed in the their places can be paid from 01.06.2011.
               
In the case of promotions (43 Claimants) it is clarified that they can be paid salary of the promoted posts from 1.6.2011 and substitutes appointed in their places, can be paid salary with effect from 1.6.2011 provided such substitutes were already in the position before 31.3.2011. It is also clarified that 43 claimants can be paid salary at the rate of lower category till 1.6.2011. Payment of salaries to substitutes before 01/06/2011 and at higher scales to 43 claimants before 01/06/2011 will be considered on a case to case basis in line with the amendment to KER
(c)
There are cases where bond has already been executed, but due to technical reasons the appointments were not approved till date whether such appointments can be approved retrospectively or prospectively.

               In all cases where bond has been executed the appointments of teachers in Appendix I can be approved with effect from 01/06/2011 for the time being. Prior period of approval will be considered on a case to case basis in line with the KER amendment.

(d)
Whether leave substitutes appointed in the current year can be approved. If the period of appointment exceeds 8 months whether they can be approved on scale of pay basis as per GO (P) No.56/11/Gl.Edn. dated 20.02.2011 or on daily wages only.

               All appointment made against Leave vacancies exceeding eight months can be approved with effect from 01.06.2011 on regular scale provided such appointments have been effected before 01/10/2011, i.e., the date of GO(P) No.199/2011/G.Edn. However, if appointments are made against any leave vacancies after 01/10/2011, the same can be approved on daily wages basis till the teachers bank is formally constituted and leave substitutes are made available from the bank.

(e)
Higher Level Verification conducted during 2010-11 but division not sanctioned. Whether it can be sanctioned during the current year.

               Additional division can be sanctioned based on the Higher level verification conducted during 2010-2011.

(f)
In certain schools shift system was abolished. Whether the vacancies caused by such abolished of shifting system can be filled up by protected teachers or by fresh appointment by the Manager.
